Terms of Service

These terms are an agreement between you and Who Spent Most ("we", "us"), which runs whospentmost.com. By creating an account or making a purchase, you agree to these terms and to our Privacy Policy.

1. What you're buying

Each purchase buys a paid listing on a public leaderboard. Your listing shows a display name (or "Anonymous"), an optional message, your rank, and your total amount spent on that list. The listing is delivered as soon as your payment succeeds, when your entry appears or moves up on the list.

A listing is a digital service. It doesn't include any prize, reward, physical item, ownership stake, or right to a future payment. Listings can't be transferred, resold, or exchanged for money.

2. How ranking works

• Every purchase adds to your account's total on that list.
• The highest total ranks first.
• If two totals are equal, whoever reached that total first ranks higher. To pass someone, you need at least $1 more than they have.
• Each list has an all-time ranking and a monthly ranking. The monthly ranking resets at 12:00 a.m. Eastern Time on the 1st of each month. Your all-time total never resets.
• Other people can pass you at any time by spending more. We don't guarantee any rank or how long you'll keep it.

3. Who can use the site

• You must be at least 18 years old.
• You may have one account. Keep your sign-in details secure; you're responsible for activity on your account.
• You must give accurate information and use a payment method you're authorized to use.

4. Payments

• All prices are in US dollars (USD). The minimum purchase is $1, in whole dollars.
• Payments are processed by Stripe. We never receive your full card number.
• Your card statement will show WHOSPENTMOST.COM.
• You're responsible for any taxes or fees your bank charges, including foreign transaction fees.
• We may limit purchase amounts, require extra verification, or decline payments to prevent fraud.

5. Refunds

All sales are final. Because your listing is delivered as soon as you pay, we don't offer refunds for change of mind, for being passed by someone else, for losing a monthly rank when the list resets, or for entries removed for breaking these terms.

We will refund you if:

• you were charged more than once for the same purchase, or
• you were charged but a technical problem on our side meant your listing never appeared.

6. Chargebacks

If you have a problem with a charge, contact us first at support@whospentmost.com. Most billing problems can be fixed quickly.

If you file a chargeback or payment dispute with your bank for a purchase that was delivered as described, we will:

• permanently ban your account,
• remove all of your entries from every list, without refunding other purchases, and
• respond to the dispute with records showing your purchase, your acceptance of these terms, and the delivery of your listing.

Banned users may not create new accounts.

7. Content rules

Names and messages can contain text and emoji only. You may not post anything that:

• contains hate speech or slurs, or attacks people based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or similar traits;
• harasses, threatens, or bullies anyone;
• is sexually explicit;
• impersonates a real person, business, or Who Spent Most;
• includes someone else's personal information, such as a phone number or address;
• contains links, web addresses, or ads (until we offer business listings);
• infringes someone else's trademark or other rights; or
• is illegal or promotes illegal activity.

8. Moderation and reports

Anyone can report an entry. We review reports and may edit, hide, or remove any entry, at any time, if we believe it breaks these rules. Your purchase total stays on your account unless your account is banned. Removed entries aren't refunded.

9. Your content

You keep ownership of what you post. You give us a non-exclusive, worldwide, royalty-free license to display, store, and reproduce your name and message on the site and in promotion of the site, such as screenshots of the leaderboard. You're responsible for what you post.

10. Closing accounts

You can ask us to delete your account at any time. Deleting your account removes your entries but doesn't make purchases refundable. We may suspend or close accounts that break these terms. If we shut down the site, we'll give at least 30 days' notice on the site.

11. Disclaimers and liability

The site is provided "as is" and "as available." We don't guarantee it will always be available or error-free. To the fullest extent the law allows, we aren't liable for indirect, incidental, or consequential damages, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim.

12. Governing law

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Durham County, North Carolina, unless the law where you live requires otherwise.

13. Changes to these terms

We may update these terms. We'll change the date at the top, and for significant changes we'll notify account holders by email before they take effect. Purchases are governed by the terms in effect when you made them.
